Consumer rights and remedies are a rapidly evolving area of the law, which encompasses a vast array of legal rights and remedies covering many different fact situations.

In the final analysis, however, most consumer rights cases involve a wrong, injury or fraud on a consumer, as a result of doing business with a variety of actors in predatory situations. Among many examples, special consumer rights range from and arise when buying certain products, like mobile homes or manufactured housing, to receiving certain drugs and medicines, as more recently highlighted in press coverage of the opioid addiction epidemic. Similar rights arise with unique financial transactions with the likes of payday lenders, pawnshops and other financial intermediaries. Another rapidly emerging area of consumer law and remedies relates to individual privacy rights, data sharing, and identity theft.

Many attorneys often specialize in one or two of these consumer rights areas of practice. For example, many lawyers now specialize in protecting and advising on privacy law and identity theft issues.

In almost all the situations described here, and related matters, the consumer should consult with an attorney. The attorney must expend considerable time and effort to learn not just the facts of the consumer’s situation, but also often very complicated and complex legal systems that govern unique consumer law situations. For example, if a consumer has a complaint about a payday lender, he or she should consult with an attorney who is familiar with the unique and complex legal regulations that govern these lenders.
